On‑Cor Frozen Foods, LLC. (“On‑Cor” or “We”) respects your privacy and is committed to protecting it through our compliance with this Privacy Policy (“Privacy Policy”).

1. Information Collected  

  • Information You Knowingly Provide. We collect information you knowingly provide to us, for example, when you submit an application for employment with us, fill in forms on our website (“Site”), communicate with us via email addresses specified on our Site, or when you contact us about our products or services. Such information may include your personal information. Personal information is any information by which you may be personally identified, such as your name, postal address, telephone number, email address, date of birth, Social Security Number, employment, financial or health information and any other information defined as personal or personally identifiable information under an applicable law. 

    Information Automatically Collected Through Technologies.
    We may use automated technology to collect information from your computer system or mobile device when you visit our facilities or use our Site. Such information may include your operating system or browser type, screen resolution, language, city and country to create reports for system administration. We do not receive personally identifiable information from the use of automated technology.

    Automated technology may include cookies, web beacons and similar tracking technologies. A “cookie” is a small text file that is placed onto an Internet user’s web browser or device and is used to remember and/or obtain information about the user. A “web beacon” is a small object or image that is embedded into a web page, application, or email and is used to track activity.  They are also sometimes referred to as pixels and tags.  

  • Information from Other Sources. We may collect information about you from other companies and organizations.  For example, we may need to obtain personal information about you from third parties in order to process your job applications.  We may also collect information that is publicly available.  For example, we may collect information about you when you interact with us through social media.

2. Use of Information Collected

We may use the information collected for purposes described in this Privacy Policy or as otherwise disclosed to you on our Site or in connection with our business operations. For example, where permitted under applicable law, we may use the information that you provide or about you to:

  • Provide and deliver products and services you request;
  • Communicate with you regarding your orders, purchases, accounts, employment applications or promotions entries;

  • Operate and improve our Site, products, and services;

  • On‑Cor affiliates. We may share your information with our affiliates.  Our affiliates who receive this information from us are not authorized to use or share the information, except as set out in this Policy.
  • Third Party Vendors.  We may share your information with vendors who provide services to us, such as fulfilling orders, providing data processing and other information technology services, auditing, compliance, and corporate governance functions.
  • Legal Obligations and Rights.  We may share your information in connection with: (i) the establishment, exercise, or defense of legal claims; (ii) to comply with laws or to respond to lawful requests and legal process; (iii) to protect the rights and property of On‑Cor, our agents, customers, and others, including to enforce our agreements, policies, and terms of use; (iv) to detect, suppress, or prevent fraud; (v) an emergency to protect the personal safety of On‑Cor, its customers, or any person; or (vi) as otherwise permitted by applicable law.
  • Business Reorganization or Sale. We may, for strategic or other business reasons, decide to sell or transfer all or a portion of our business.  As part of that sale or transfer, we may pass information we have collected and stored, including customer information, to anyone involved in the sale or transfer.
  • Consent.  We may share your information for any other purposes with your consent.

We may also share aggregated or anonymized information in a form that does not directly identify you.

Except as provided herein, On‑Cor does not sell, transfer or otherwise share your personal information with other third parties.

4. Children's Privacy

Our Site is not intended for children under 13 years of age. We do not knowingly collect information from children under 13. If you believe that we might have any information from or about a child under 13, please contact our compliance representative listed below and we will use reasonable efforts to promptly delete the child's information from our records.

 5. Your Choices

We do not share personal information with third parties for their own direct marketing purposes.  You are in control of any personal information you provide to us.  If at any time, you would like to access, correct or delete your personal information in our records, you may do so by contacting our compliance representative listed below. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Notice to California residents under 18 years of age

If you are a registered user of online services under the age of 18, and we have actual knowledge of your age, then under California law you may request and obtain removal of certain content or information you have posted on our online services.  To do so, please contact us at the address, phone number or email address below.  Please note that removal does not ensure complete or comprehensive removal of the content.  For example, removal may not be possible or permitted if another provision of law requires the content to be maintained, if it was posted or reposted by others, or if we paid compensation to you in exchange for the posting.

6. Retention and Security of Personal Information

On‑Cor will retain your personal Information only for as long as necessary to fulfill the purpose(s) for which it was collected and to comply with applicable laws and your consent to such purpose remains valid after termination of our relationship with you.

We are committed to taking appropriate measures designed to keep your personal information secure.  While we will take reasonable steps to safeguard your personal information against accidental, unlawful or unauthorized loss, access, use, alteration, disclosure or destruction, no website, mobile application, computer system, or transmission of information over the internet or any other public network can be guaranteed to be 100% secure.

We urge you to be careful online. This includes not sharing your user names and passwords. Any transmission of personal information by you through such mediums is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on those mediums.

7. Links to Other Site and Social Media

Please note that our Site may contain links to third party websites for your convenience and information. On‑Cor does not control or endorse those sites or their privacy practices, and this Privacy Policy does not apply to third party websites. We encourage you to review the privacy policy of those third party websites before providing your personal information to them.

8. EU-U.S. Privacy Shield

On‑Cor, through its parent, participates in the EU-U.S. Privacy Shield Framework (“Privacy Shield”) administered by the U.S. Department of Commerce regarding the collection, use and retention of personal information transferred from the European Union to the United States. On‑Cor has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. As a Privacy Shield participant, On‑Cor is committed to and has certified that it adheres to the Privacy Shield Principles for all personal information received from the European Union in reliance on the Privacy Shield. Please note the following:

On‑Cor may be liable under the Privacy Shield if these vendors process such personal information in a manner inconsistent with the Privacy Shield and On‑Cor is responsible for the event giving rise to the damage.

Indemnification

By using this Site you agree to indemnify, defend, and hold the On‑Cor Team harmless from and against any and all claims, damages, losses, costs (including, without limitation, reasonable attorneys' fees and court costs) and liabilities arising out of or in connection with any violation by you of these Terms of Use, or any misrepresentation made by you; and/or the On‑Cor Team's use of your information. You will cooperate as fully and as reasonably required in On‑Cor's defense of any claim. On‑Cor reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and you shall not in any event settle any such matter without the written consent of On‑Cor.

Sweepstakes and Promotions

Any sweepstakes or promotions offered on the Site are subject to the official rules for each such sweepstakes or promotion. By entering such sweepstakes or promotion, you agree to comply with its rules, and the decision(s) of the sponsor(s) thereof, which shall be final and binding in all respects.

Governing Law

These Terms of Use will be governed by and construed in accordance with the laws of the State of Illinois, notwithstanding its conflict of law rules. You expressly agree that the exclusive jurisdiction for any claim or dispute arising under or in connection with these Terms of Use or your use of the Site resides in the state and federal courts located in Illinois, and you further expressly agree to submit to the personal jurisdiction of such courts for the purpose of litigating any such claim or action. If you access or use the Site from a location outside of the United States of America, you must do so in compliance with any local laws, for which we make no guarantee. Any software that you may download from the Site may be subject to export restrictions imposed by the United States, and may not be exported to countries where the United States has placed an embargo or to a company or individual that appears on the Specially Designated Nationals list of the U.S. Department of the Treasury or the Table of Deny Orders of the U.S. Department of Commerce.

Severability

If any part of these Terms of Use is unlawful, void, invalid or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions, which shall remain in full force and effect. No waiver of any provision in these Terms of Use shall be deemed a further or continuing waiver of such provision or any other provision. Evidence of use of the Site for illegal purposes will be provided to law enforcement authorities.

On‑Cor Supply Chain

California Transparency in Supply Chains Act Disclosure

On‑Cor Frozen Foods, LLC supports the goals of the California Transparency in Supply Chain Act of 2010 ("Act") and strives to continually improve our processes and practices to maintain high standards in the ethical sourcing of materials used in our products. Our efforts so far in aligning with the Act's requirements include the following:

Certifications by Direct Suppliers

To help assure our procurement is free from slavery and human trafficking, our supply agreements incorporate language requiring suppliers to warrant compliance with the Act and any known violation may result in immediate termination of the agreement.

Further, our supplier code of conduct makes clear our commitment to fair labor standards and our expectation toward our suppliers to share this commitment. The supplier code of conduct requires our suppliers to adhere to certain principles and practices, including workplace safety, equal employment opportunities and fair employment practices prohibiting child labor, forced labor, or any form of slavery or human trafficking.

Our supplier code of conduct is embedded into our procurement practices as follows:

  1. All new suppliers are required to acknowledge the supplier code of conduct as part of their on-boarding process;

  2. A link pointing to our purchase order terms and conditions and the supplier code of conduct is referenced in each SAP system-generated purchase order, allowing our suppliers access to a website that uploads the latest version of the supplier code of conduct; and

  3. When necessary, a hard copy of the latest version of the supplier code of conduct is issued to our current supplier community.

Verification and Audits of Product Supply Chains

In addition to our supply contracts and supplier code of conduct, we are now designing a risk-based verification process to identify high-risk suppliers and developing an appropriate responsible-sourcing audit approach to ensure our product suppliers are in compliance with our supplier code of conduct.

On‑Cor reserves the right to audit our suppliers' compliance with the supplier code of conduct by On‑Cor or its approved third party. If an audit identifies a violation of our supplier code of conduct, On‑Cor reserves the right to demand prompt corrective measures by our suppliers to On‑Cor's satisfaction and the right to terminate any and all business if not corrected on a timely basis.

Internal Accountability Standards

At On‑Cor, we are committed to conducting business with the highest integrity and in compliance with all applicable laws and regulations. Our employees are expected to adhere to the principles described in our business standards. The principles stated in our business standards apply to all aspects of our business, including those pertinent to entitlement to work, ethical sourcing and partnering with suppliers who act as good corporate citizens. Violators are subject to disciplinary action, up to and including termination of employment.

Employee Training

In 2011, we rolled out an online training program for our business standards to our management employees. We are now designing a compliance program with the goal of ensuring more robust compliance training throughout each level of our organization. In addition, On‑Cor provides employees responsible for supply chain management and procurement with on-going opportunities to update the company's practices with respect to ethical sourcing. Our supply chain personnel participate in industry trade groups, on-line industry and academic programs as well as benchmarking practices against those of other companies in the food industry.
